Last month we spoke to a lady who was residuary beneficiary of an estate. A firm of solicitors in the South East who had acted for the deceased for years and held the original will had been instructed to administer the estate. The lady was unhappy with the service provided, there was a lack of communication and unnecessary delays, and despite complaining no progress had been made.
The lady was surprised to learn that if she was unhappy with the service she could choose to instruct a different firm or deal with the administration herself. This is the case even if the deceased chose to name a professional such as a solicitor or bank as executor in their will provided that the request to step down is made before they take any action to administer the estate.
